Bad News For ‘Fortnite’ iOS Players And Season 4 - Forbes

The legal battle between Epic Games and Apple has begun, and while the first major decision from Judge Yvonne Gonzales Rogers contains victories for both the Fortnite developer and the iPhone manufacturer, it’s not great for iOS users that were hoping to jump into Season 4 when it kicks off on Thursday, April 27.

For Epic’s part, the Judge ruled that Apple cannot cut off iOS access to the Unreal Engine, arguing that it was a retaliatory action that would affect third-party developers far beyond Epic Games itself. This was one of Epic’s major concerns going into the arguments, and game developers all over the world are likely breathing a sigh of relief.

“Apple is hard-pressed to dispute that even if Epic Games succeeded on the merits, it could be too late to save all the projects by third-party developers relying on the engine that were shelved while support was unavailable,” writes Rogers.

The decision leaned towards Apple with regards to Fortnite itself, however, which Apple removed from the App Store after Epic Games bypassed the App Store payments and allowed players to buy directly from them for a discount. Rogers ruled that Epic intentionally breached its agreement with Apple and finds itself in a situation “of its own making”, and the game will remain off the App Store for the foreseeable future.

“The Court finds that with respect to Epic Games’ motion as to its games, including Fortnite, Epic Games has not yet demonstrated irreparable harm. The current predicament appears of its own making”.

“The Court observes that Epic Games strategically chose to breach its agreements with Apple which changed the status quo”, she continued.

In practical terms, this means that Epic Games will not be able to update Fortnite on iOS, and that anyone who plays exclusively on iOS will be unable to update to Season 4, when the rest of the community will be flying high as Marvel superheroes, playing with new items, and doing all the stuff that one generally does at the beginning of a season. Epic seems to be hoping that the anger from iOS users will help add to the public pressure as the legal battle continues.
